Welcome to the website www.lolo-chatenay.com, website for the sale of online leather goods and fashion accessories.
We invite you to carefully read these General Terms of Use and Sale (hereinafter referred to as “GTC/GTS”) as well as our policy on the protection of personal data so that you can navigate and order on our website. The User, natural person, customer or not, is informed that they are bound by these GTC/GTS.
The use of the services of our website, as well as any order, implies prior, full and complete acceptance of these GTC/GTS and our personal data protection policy that you acknowledge having read.

II. GENERAL TERMS OF USE
Any access and/or use of the website www.lolo-chatenay.com implies compliance with all the provisions of these terms and conditions and their acceptance. These thus constitute a contract between the company LOLO CHATENAY and the User/Customer.
1/ Definitions
Customer: Is defined as any natural person acting for purposes that are outside the scope of their trade, business, craft or profession, who are at least 18 years of age, and who have ordered at least once on the Website.
The Customer has a LOLO CHATENAY customer account.
Username: Is understood as the e-mail address required to identify a User on the website so that they can access their account.
Password: Is understood as the sequence of characters that the User must keep secret and that allows them, together with their Username, to access their account.

User: The User is understood as any person using the Website www.lolo-chatenay.com or one of the services offered on it.
Identified User: The Identified User is understood as any person using the Website www.lolo-chatenay.com or one of the services offered on it and having a LOLO CHATENAY account.
Terms of access and use of the Website: The Website is free to any User with Internet access.
The User is responsible for their computer equipment and their Internet access. All costs related to Website access are borne by the User/Customer.
The User can only access their account after identification using their Username and Password. The User is obligated to keep their Username and Password secret and must not disclose it to third parties.
The company LOLO CHATENAY will implement all means to ensure access to the Website 24 hours a day, 7 days a week but it cannot be held liable for any problems or dysfunction of the Website that would prevent any access to the Website and/or to the various services offered by LOLO CHATENAY.
LOLO CHATENAY shall endeavour to resolve any problem as soon as possible.

The User has the possibility of creating an account on the Website.

In creating their account, the User accepts these GTC/GTS and our personal data protection policy.
Access to services includes subscriptions to LOLO CHATENAY newsletters. The Identified User has the possibility, at any time, of modifying the information they want to receive or unsubscribing by clicking the link provided for this purpose at the bottom of each newsletter. This link is also available on the Website under "My Account".
Account creation on the Website is restricted to any person aged at least 18 years. Each User can only create one LOLO CHATENAY account.
All fields in the account creation form must be filled in with the exception of the fields designated as optional. Any failure to reply will cause the non-creation of the account. All the information entered by the User must be accurate. The Customer may enter a phone number of their choice: office and/or mobile and/or home telephone.
When the User creates an account on the Website, they receive an account creation confirmation e-mail the same day.
LOLO CHATENAY reserves the right to remove any account that does not meet these contractual conditions.
III. GENERAL TERMS OF SALE
The General Terms of Sale define the conditions applicable to the sales made, on the one hand, between the persons making a purchase via the website www.lolo-chatenay.com, hereinafter the "Customer” and, on the other hand, the company LC Design sas, hereinafter referred to as "LOLO CHATENAY". These terms apply exclusively to non-commercial individuals.
1/ Price of the items
All the prices are indicated in Euro all taxes included, excluding shipping costs (see Shipping and Delivery Section).
The duration of validity for the prices of the items offered on LOLO CHATENAY is 24 hours from their publication on the Website www.lolo-chatenay.com. The items will be invoiced based on the rates in effect at the time of the order entry. They remain the property of LOLO CHATENAY until full payment of the price is received by LOLO CHATENAY. This price is payable in full in one payment.
2/ Order
The Customer can place an order on the Website www.lolo-chatenay.com.
The order process is as follows:
Choice of items or creation on the configurator and addition to the basket
Confirmation of the basket contents
Identification on the Website www.lolo-chatenay.com, if the Customer is not already identified
Choice of delivery method
Choice of the payment method and acceptance of the GTSs
Confirmation of payment
The Customer will receive an order confirmation email.
The Customer can, during these different stages, see the details of their order and its total price and correct any errors, before confirmation to express their acceptance.
LOLO CHATENAY reserves the ownership of the items until full settlement of the order, that is to say collection of the order price by LOLO CHATENAY.
LOLO CHATENAY reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over the payment of a previous order or who presents any form of risk to them.
Any order implies acceptance of the prices and description of the items available for sale.
The photos of the items ordered on the website www.lolo-chatenay.com are not contractual.
The leathers and other materials may be subject to change in colour and appearance.
LOLO CHATENAY reserves the right to verify the personal data provided by the Customer and adopt all the measures deemed necessary to verify that the person that placed the order is the person holding the Customer account and/or holding the means of payment used, so as to avoid identity theft or fraudulent payment.
3/ Shipping and Delivery Time
LOLO CHATENAY is only committed to fulfilling orders received on the Website while stocks last.
For customised orders the lead time is 21 business days. In the case of delay in the order, LOLO CHATENAY undertakes to inform the Customer as soon as possible and, if necessary, to reimburse them no later than 14 days after the date on which they exercised their right of withdrawal. The Customer's order will be automatically cancelled.
LOLO CHATENAY undertakes to deliver the items ordered and paid by the Customer, in mainland France, by the following deadlines:
- Colissimo suivi: Mainland France: 48 to 72 hours after shipment. (Free delivery from €30 purchase, Monday to Saturday.)
- Chronopost Express: Mainland France: 24 to 48 hours after shipment. (Express service charged €10, regardless of the amount of the order. Delivery from Monday to Saturday.)
If such items are not delivered within seven days from the delivery date provided when ordering, and if this overrun is not due to force majeure, the Customer may proceed with the cancellation of the sale by sending a registered letter with acknowledgement of receipt to the following address: LOLO CHATENAY, Customer Services, 50 Bis Avenue du Progrès Chassieu.
The amounts paid by the Customer will be fully returned to them.
The Customer must check the condition of the items delivered.
Any anomaly concerning the items (damage, missing item in relation to the order, damaged or opened package, broken or defective item, etc.) must be indicated within three days of delivery.
4/ Payment
Payment for purchases is the Customer’s choice:
- By credit card: Visa, MasterCard, Debit Card, issued in France
- By credit card in two instalments without fee: Visa, MasterCard, Debit Card, issued in France
Confirmation of payment
Payment is validated upon receipt of the additional information requested in the case of credit card payment that requires additional checks (see Section Combating credit card fraud).
5/ Recording of bank details
Fill in your contact information (the bank data entered on the payment page is encrypted and secure).
Confirm payment.
Once payment is confirmed, data related to delivery (delivery method and address), invoicing and the credit card used are recorded.
The Customer's bank details are never known or stored by LOLO CHATENAY but only by the Bank (Crédit Mutuel CM - CIC p@iement) on secure servers.
LOLO CHATENAY reserves the right to verify the personal data communicated by the Customer.
6/ Payment in two instalments by credit card without fee
Customers of LOLO CHATENAY can make a payment by credit card in two instalments. The instalments are automatically debited.
- The first instalment is taken at the end of the order month.
- The second instalment is taken 30 days after collection of the first instalment.
In any cases of default, the remaining instalments are cancelled and the amount requested for recovery will equal the entire amount still owed by the Customer. If the Customer decides to exercise their right of withdrawal, LOLO CHATENAY will refund them the full amount paid.
In case of total cancellation of an order paid for in two instalments, the order is cancelled and the Customer is refunded the amounts paid and the instalments are cancelled.
In case of return of all the products of an order and after positive product examination by our warehouse, the Customer is reimbursed and the instalments are cancelled.
In the event that the Customer's credit card expires before the second instalment plus seven days, the order will be refused by LOLO CHATENAY.
When it is proposed, this payment method is shown on the order payment page.
7/ Combating credit card fraud
LOLO CHATENAY will also be free to proceed with the direct cancellation of an order that would present one or more risk factors for the fraudulent use of a credit card.
8/ Exchange, return and refund
Deadline for returning an item: The Customer has a statutory period of 14 days to exercise their right of withdrawal from the date of receipt of the goods without having to provide reasons or pay penalties. The terms for exercising this right of withdrawal are mentioned under the section “Terms of exchange and return" below.
The return costs are borne by the Customer. The Customer will receive a full refund of the amounts paid upon receipt and verification of the return of their items and, at the latest, within 14 days of the date on which they exercised their right of withdrawal. LOLO CHATENAY may withhold the refund until receipt of the items in our warehouse or receipt of proof of the shipping of the items, whichever is the earliest of these events. LOLO CHATENAY will reimburse the Customer using the same means of payment as for the initial transaction.
9/ Conditions of exchange and return for refund
Exception to the right of withdrawal: In accordance with Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to the supply of goods made according to the consumer's specifications or that are clearly customised.
Refund or exchanges are available on all products from our Website, except for sale items and promotions.
Refunds and exchanges only apply to mainland France.
The product(s) returned must be new, unused and in their original box perfectly intact.
The order confirmation string must be intact; any breach of this string will mean the order has been legally accepted by the Customer.
Customers are advised that, in accordance with Article L. 121-20-2 of the French Consumer Code, the right of withdrawal may not be exercised for customised products.
Condition of the items: All returned items (original packaging, accessories, etc.) must be returned undamaged.
The order confirmation string and the label must be intact.
Upon receipt of the package, LOLO CHATENAY judges the perfect condition of the returned merchandise. No returns will be accepted if the returned items have been visibly damaged or used by the Customer and when such use or damage renders the items unfit for sale. If the return is refused by LOLO CHATENAY, the items will be returned to the Customer at the cost of LOLO CHATENAY without the Customer being able to demand any right to compensation or reimbursement, with the exception of the subsequent exercise of their warranty rights on the goods sold.
Returns refund: The Customer will receive a full refund of the amounts paid upon receipt and verification of the return of their items and, at the latest, within 14 days of the date on which they exercised their right of withdrawal.
LOLO CHATENAY may withhold the refund until receipt of the items in our warehouse or receipt of proof of the shipping of the items, whichever is the earliest of these events.
Upon receipt of a return package whose content does not comply with the request for return or whose items do not comply with the terms of return mentioned above, LOLO CHATENAY reserves the right to exercise any corresponding recovery actions against the Customer.
Return steps:
- Stage 1: Put your item(s) back into their original respective packaging, and place these into the box used for shipping.
- Stage 2: Print and fill in your withdrawal slip available at www.lolo-chatenay.com. Place the filled-in slip inside your package.
- Stage 3: Send your package back to the following address:

In order for your return to be taken into account, please choose a shipping method with Colissimo suivi.

We remind you that customised products cannot benefit from the right of withdrawal.
Any anomaly concerning the items (damage, missing item in relation to the order, damaged or opened package, broken or defective item, etc.) must be indicated within three days of delivery.
10 / Securing transactions
LOLO CHATENAY implements all means to ensure the confidentiality and security of the data transmitted over the internet and on the Website www.lolo-chatenay.com. As such, the Website uses a SSL (Secure Socket Layer) type secure payment.

11/ Liability
LOLO CHATENAY is fully liable towards the Customer for the proper execution of the contract with the Customer.
However, the liability of LOLO CHATENAY cannot be incurred for the non-performance or improper performance of the contract in case of force majeure, the occurrence of an event attributable to the Customer, or any inconvenience or unpredictable and insurmountable damage inherent in Internet usage, including service interruption, external intrusion or the presence of computer viruses.
The www.lolo-chatenay.com website contains hyperlinks that can direct to other websites. The liability of LOLO CHATENAY cannot be incurred for the content of these websites should they contravene the legal and regulatory provisions in force.
12/ Warranty
All the items offered by LOLO CHATENAY are subject to the statutory two year warranty provided by Articles L. 211-4 to L. 211-14 of the French Consumer Code and the warranty against hidden defects provided by Articles 1641 to 1649 of the French Civil Code.
LOLO CHATENAY cannot, however, be held responsible for any misuse and/or heavy use of the items that the Customer may make. Likewise, LOLO CHATENAY cannot be held liable for the return by the Customer of a competing product and/or a product not sold on the Website. The Customer is responsible for sending the right item.
13/ Intellectual and Industrial Property
Any texts, comments, works, illustrations and images reproduced on LOLO CHATENAY are protected under copyright as well as under intellectual and industrial property and for the entire world. As such, and in accordance with the provisions of the intellectual and industrial property code, usage is only authorised for private use, subject to various provisions, and even the more restrictive provisions of the intellectual and industrial property code.
The total or partial reproduction of the Website www.lolo-chatenay.com is strictly prohibited without prior agreement.
Any total or partial reproduction of LOLO CHATENAY products is strictly prohibited under penalty of prosecution.
14/ Applicable law
These General Terms of Use and Sale are subject to French law. In case of disagreement on the application, interpretation and enforcement of these same, and in default of amicable agreement, any dispute will be referred to the relevant court of Lyon.
